Agreement to these Terms

These Terms of Service ("Terms") govern access to and use of TapRSVP, operated by TAPRSVP INC., an Ontario corporation ("TapRSVP", "we", "us", or "our").

By creating an account, purchasing a TapRSVP service, or otherwise using a TapRSVP feature presented with these Terms, you agree to these Terms.

Guests may use public RSVP pages without creating an account.

Our Privacy Policy explains how we handle personal information.

Accounts

Hosts are responsible for providing accurate account and eligibility information and keeping their sign-in credentials secure.

A TapRSVP account is used to create and manage events, guest responses, purchases, and optional services.

You must be at least 14 years old to use TapRSVP as a host. TapRSVP does not require a date of birth solely for this eligibility check.

If you have not reached the age of majority where you live, your ability to enter into these Terms or make purchases may be subject to applicable law. TapRSVP does not collect parent or legal-guardian approval as part of ordinary host signup. Nothing in these Terms overrides mandatory capacity, consumer-protection, or other statutory rights that apply to you.

If an account is deleted and the same external sign-in method is used again later, deleted TapRSVP account and event data is not restored.

Events and RSVPs

TapRSVP applies eligibility, timing, editing, cancellation, and retention rules to events. The rules that apply to a particular event are shown in the product where relevant.

Guests can RSVP without creating an account.

A host may record an RSVP that a guest communicated directly to the host. If the host provides the guest's contact number for that purpose, the host must confirm that the guest authorized the host to provide that number to TapRSVP for the event.

Hosts are responsible for the accuracy, lawfulness, and appropriateness of guest information they submit to TapRSVP. TapRSVP does not independently verify guest information provided by a host. To the maximum extent permitted by applicable law, the host is responsible for consequences arising from false, misleading, unauthorized, or unlawfully submitted guest information.

Cancellation

Host cancellation is immediate and irreversible. Once an event is cancelled, new and edited RSVPs stop.

Cancellation does not automatically create a refund.

Prices and payment

Unless otherwise shown at checkout, TapRSVP charges in Canadian dollars.

The price, included items, discounts, and total are shown before payment.

Stripe processes TapRSVP card payments. TapRSVP does not store complete card numbers or CVCs in its application database. Stripe Checkout may collect a payer name and billing or postal address on Stripe's hosted payment page. TapRSVP does not copy the billing or postal address into the host profile or its own application database.

By submitting a payment, you confirm that you are authorized to use the selected payment method. If you are under the age of majority where you live, you remain responsible for using only a payment method that you are authorized to use, subject to any mandatory rights or capacity rules under applicable law.

TapRSVP may offer a first-event benefit subject to the eligibility rules shown with that offer. Deleting and recreating an account does not necessarily create a new first-event entitlement.

Optional services

TapRSVP may offer optional services such as a Printable Digital Invitation, RSVP Summary, and Attendee Care.

Availability and use of an optional service depend on the event's status, timing, eligibility, and any limits shown in the product.

Printable Digital Invitation

The Printable Digital Invitation is a digital event product. Ordinary customer-requested refunds are normally unavailable after purchase, subject to approved exceptions such as duplicate charges, confirmed TapRSVP failures, or product defects.

RSVP Summary

RSVP Summary provides an event response report while the event remains eligible for access. For a cancelled event, the report includes only responses received before cancellation.

Attendee Care

Attendee Care provides event-related messaging features subject to guest SMS permission, event eligibility, and the recipient limit shown in the product.

The base service includes up to 50 SMS recipients per message. An optional upgrade may increase that limit to 100 recipients.

If the number of SMS-eligible guests exceeds the included recipient limit, the host must either select recipients from those SMS-eligible guests within the applicable limit or purchase an available capacity upgrade before using the affected messaging feature. Recipient selection does not create SMS consent and does not override a guest opt-out or provider-level STOP.

SMS

Providing or storing a guest phone number, including a number provided by a host after the guest authorizes the host to provide it for the event, does not authorize TapRSVP to send SMS to that guest.

Guests must expressly opt in to applicable TapRSVP event SMS. Hosts cannot consent on a guest's behalf.

A guest may decline or withdraw SMS permission without changing their RSVP response. To stop all TapRSVP texts for any event, reply STOP. A supported START or UNSTOP action may clear a provider-level block, but it does not by itself create event-specific SMS consent.

TapRSVP may include a STOP instruction in the first TapRSVP SMS sent to a phone under the active SMS sender or Messaging Service. TapRSVP does not need to repeat that instruction in every later message under the same sender scope.

Message and data rates charged by a recipient's mobile provider may apply.

Refunds

Purchases and refunds are subject to the TapRSVP Refund Policy and any product-specific notice shown before purchase.

Host cancellation does not automatically create a refund.

Suspension and misuse

TapRSVP may restrict an account or event where reasonably necessary for security, fraud or abuse prevention, suspected unlawful activity, service integrity, or compliance with law.

Where a restriction, suspension, or cancellation results from the host's conduct, event content, misuse, or another issue attributable to the host, that action does not create a refund entitlement, subject to rights or remedies that cannot lawfully be excluded. Refunds and reversals for verified TapRSVP payment or service failures are handled under the TapRSVP Refund Policy.

You must not use TapRSVP to:

• violate applicable law or another person's rights;
• send spam or bypass consent or STOP controls;
• submit fraudulent or unauthorized payment activity;
• interfere with or circumvent TapRSVP security;
• upload malware or harmful code;
• impersonate another person or misrepresent your authority to act for an event.

Your content

You are responsible for event titles, notes, guest information, messages, and other content you submit.

You give TapRSVP permission to host, process, display, transmit, and otherwise use that content only as reasonably necessary to provide the service, comply with law, and protect the service.

You must have the rights and permissions reasonably necessary to provide the content and personal information you submit.

TapRSVP ownership

TapRSVP, its software, branding, and service materials remain the property of TAPRSVP INC. or its licensors.

These Terms do not transfer ownership of TapRSVP's software, branding, or service materials.

Account deletion

Eligible hosts can initiate account deletion directly from their TapRSVP profile.

Deletion removes or irreversibly minimizes TapRSVP-controlled account and event data, subject to records that must be kept for a separate legitimate purpose, such as transaction, refund, support, consent/opt-out, fraud-prevention, or legal-hold records.

Account deletion does not itself create a refund.

Service availability

TapRSVP depends on third-party services for functions such as hosting, authentication, payments, email, and SMS. We do not guarantee that every feature or delivery will always be uninterrupted or error-free.

We may update or discontinue future features, prices, limits, or optional services. Completed purchases remain subject to the terms and product disclosures that applied to that transaction, except where a change is required by law, security, or a necessary service remedy.

Nothing in these Terms excludes consumer rights or remedies that cannot lawfully be excluded.

Limitation of liability

To the maximum extent permitted by applicable law, TapRSVP is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business, opportunity, goodwill, anticipated savings, or event-related costs arising out of or relating to the Service, including an interruption, delay, delivery failure, or unavailability of the Service or of a third-party service on which TapRSVP depends.

To the maximum extent permitted by applicable law, TapRSVP's total aggregate monetary liability arising out of or relating to a claim will not exceed the total fees actually paid to TapRSVP for the event to which the claim relates. If a claim does not relate to a specific event, the cap is the amount actually paid for the TapRSVP service that gave rise to the claim.

Any refund, credit, reversal, or other monetary remedy provided by TapRSVP for the same claim will be credited against this limit and does not create a separate additional entitlement.

Nothing in this section limits any liability, right, or remedy that cannot lawfully be limited or excluded under applicable law.

Governing law

Except where applicable law requires otherwise, these Terms and your use of TapRSVP are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles.

Nothing in these Terms excludes or restricts any mandatory consumer-protection, jurisdictional, or other statutory right that applies to you under the law of your province or territory and cannot lawfully be waived or limited.

Changes to these Terms

We may update these Terms as TapRSVP changes.

Where applicable law requires notice or renewed agreement for a material change, we will provide it.

The current version will show its effective or last-updated date.
